Reclaim San Diego Radio: John Eastman Unpacks Election Integrity and Judicial Overreach
On the May 17, 2025, episode of Reclaim San Diego Radio, hosts Dr. Gary Cass and Christine Reagan welcomed constitutional scholar John Eastman to discuss pivotal battles for election integrity and judicial accountability. As San Diego’s voice for reclaiming its 145-year conservative heritage, the show united its 10,000 local advocates with Act for America’s 5 million nationwide members to fight for families, safe communities, and constitutional liberties. Eastman, a former Trump administration advisor and director of the Center for Constitutional Jurisprudence, brought fresh insights from his Supreme Court appearance the previous day, alongside reflections on the contested 2020 election.
Eastman detailed his role in challenging the 2020 election’s legality, arguing that state officials violated Article 2 of the Constitution by altering election codes without legislative approval. “County clerks, secretaries of state, and judges got rid of signature verification, opened drop boxes in heavily Democrat areas, and ignored bipartisan oversight in nursing homes,” he said, citing Pennsylvania’s 120,000 excess ballots and Wisconsin’s fraudulent nursing home votes. He revealed that Vice President Pence received letters from hundreds of state legislators requesting a delay in certification to assess these irregularities, but Pence refused, claiming no authority—a move Eastman called a missed opportunity to uphold consent of the governed.
The conversation shifted to Eastman’s Supreme Court case challenging nationwide injunctions by district judges, which have blocked Trump’s agenda, including his executive order on birthright citizenship. Eastman clarified the 14th Amendment’s original intent, stating, “It requires full allegiance, not just being born here—children of illegal immigrants or temporary visitors don’t qualify.” He debunked the 1898 Wong Kim Ark case as precedent, noting it applied only to lawful permanent residents, not illegal immigrants, despite Justice Sotomayor’s claim that it settled the issue 127 years ago.
Eastman warned of the consequences if these injunctions persist: “A single judge in Seattle can block an administration’s agenda, disenfranchising millions who elected Trump.” He predicted a split court, with Justices Kagan, Sotomayor, and Jackson likely supporting injunctions, while Alito, Thomas, Gorsuch, Kavanaugh, Barrett, and Roberts have criticized them. A favorable ruling could curb judicial overreach, allowing Trump to execute policies like mass deportation, supported by 80% of Americans per Reagan.
